These terms are an agreement between you and ElevationArk LLC about the Sir Flappicus affiliate program (the "Program"). By applying in the game you agree to them.
1. Who can join
- You must be at least 18 years old (or the age of majority where you live, if higher) and able to enter a binding contract.
- You need a Sir Flappicus account signed in with email, Google or Apple. Guest accounts can't apply.
- To be paid you must complete Stripe's identity, tax and bank checks and live in a country Stripe supports for payouts.
- We review every application and may accept or decline it at our discretion. If we decline, you may apply again after 30 days.
2. Your invite code
Once accepted, you choose one invite code: a single word of 3 to 7 letters. Codes can't be changed after you claim them. We may refuse codes that are offensive, misleading, or that look like official, store or third-party names, and we may retire a code that breaks these terms.
Players aged 13 or older (or older where local law requires) can enter your code once per account, within 14 days of first playing. They receive a one-time reward (currently 2,500 coins, the Early Bird trail and the Backwards Cap). Players can't use their own code. Players under that age can't enter codes and never count toward your earnings.
3. What you earn
You earn a commission of 80% of Net Revenue from each player who used your code, counted only on that player's first $50 USD of purchases at list price.
- Net Revenue means, for each purchase, the item's US dollar list price shown in the game, minus the app store's service fee (currently 15%) and minus a tax allowance (currently 0%, so nothing is deducted for taxes). We use the same fixed amounts for every country so that commissions are predictable. The current amounts for each item are available from support on request.
- Only purchases verified by Apple or Google count. Test and sandbox purchases don't count.
- A purchase that crosses the $50 limit counts only up to the limit.
- The most you can earn from one invited player is therefore $34.00 under the current store fee and tax allowance.
4. Refunds and holds
Earnings are held for 45 days after each purchase in case it's refunded. If a purchase is refunded or reversed before payout, its commission is cancelled. If it's refunded after we've paid you, the commission is deducted from your future earnings. Refunded spending no longer counts toward the player's $50 limit.
5. Payouts
- We pay through Stripe Connect, once a month on the 2nd, when your available balance is at least $25 USD. Smaller balances carry over.
- You set up a Stripe Express account through Stripe's own pages, which the game opens for you. We never see your bank details. Stripe's Connected Account Agreement applies to your Stripe account.
- Payouts are made in US dollars. Stripe or your bank may convert them and charge their own fees.
- If a payout can't be made (for example, your Stripe account isn't complete), your balance stays owed to you for 24 months, after which unclaimed balances are handled as required by law.
6. Taxes
You're responsible for the taxes on your earnings. Stripe asks for your tax information when you set up payouts: US affiliates give the details for Form W-9 (including a taxpayer ID), and affiliates outside the US give the information for a Form W-8 where Stripe asks for it. We, or Stripe for us, may report your earnings to the IRS and send you a Form 1099 (such as Form 1099-NEC) where the law requires. We may hold payouts until the tax information Stripe needs is complete.
7. How you must promote
- Disclose that you're paid. Every post, video or stream that shares your code must clearly say that you earn money when people use it (for example, "I get paid when you use my code"). Follow the FTC Endorsement Guides and similar rules where you live.
- Don't target children under 13, and don't make content directed at children to promote your code.
- Don't make false or misleading claims about the game, its rewards or what players will get.
- Don't offer cash, gifts or anything else to get people to use your code, buy things, install the game, or leave ratings or reviews.
- Don't use paid search ads on our names, spam, bots, fake accounts, or your own or family members' accounts to generate earnings.
- Don't present yourself as us, as Apple or Google, or as speaking for us.
8. What you can see
Your Affiliates page shows totals only: how many players used your code, how many bought something, and your held, available and paid earnings. To protect players, many of whom are minors, we never tell you who used your code or what any individual bought.
9. Suspension and ending
You can leave the Program at any time by contacting support or deleting your account. We may suspend your code or end your participation if you break these terms, if we suspect fraud, or if we close the Program, with notice where reasonable. Earnings from fraud or broken rules are forfeited. Otherwise, earnings already earned and not reversed will be paid under section 5. If you delete your account, earnings not yet paid are forfeited unless the law requires otherwise.
10. Changes
We may change these terms, including the commission rate, limits, holds and tax allowance, with at least 30 days' notice on your Affiliates page or by email. Changes don't affect commissions on purchases made before they take effect.
11. Relationship and liability
You're an independent contractor, not our employee, agent or partner. To the extent allowed by law, our total liability to you under the Program is limited to the commissions owed to you in the 12 months before the claim. Nothing in these terms limits rights that can't be waived by law.
12. Governing law
These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules, except where your local law gives you rights that can't be waived. Disputes are handled as described in section 13 of the Terms of service.
